利用規約

この利用規約（以下「本規約」）は、個人が運営するルート共有サイト「RouteCross」（以下「本サービス」）の利用条件を定めるものです。本サービスを利用した場合は、本規約に同意したものとみなします。

この日本語版が正本です。英語版は参考訳で、内容が食い違う場合は、日本語版が優先されます。

Terms of Service

These Terms of Service (the “Terms”) set out the conditions for using RouteCross (the “Service”), a route-sharing site run by an individual. If you use the Service, you are deemed to have agreed to these Terms.

This is an English translation of the Japanese version, provided for reference. If the two differ, the Japanese version prevails.

第1条（本サービスについて）

本サービスは、バイクツーリングやドライブのルートを、KML/KMZ ファイルで共有・発見できるサイトです。ナビゲーションアプリではありません。

  • 運営者は個人です。本サービスは無償で提供します。
  • 運営者は、本サービスの内容を、予告なく変更することがあります。また、提供を中断・終了することがあります。

Article 1 (About the Service)

The Service is a site where you can share and discover motorcycle touring and driving routes as KML/KMZ files. It is not a navigation app.

  • The operator is an individual. The Service is provided free of charge.
  • The operator may change the content of the Service without notice, and may suspend or end the Service.

第2条（アカウントと利用できる機能）

  1. ルートの閲覧は、ログインなしで利用できます。
  2. KML/KMZ のアップロードとダウンロードは、ログインが必要です。ルートの編集・削除と、退会も、ログインして行います。ログインは、Google または Microsoft のアカウントで行います。RouteCross は、パスワードやアクセストークンを保存しません（詳しくはプライバシーポリシー）。
  3. 投稿には、ニックネームの登録が必要です。投稿できる利用者を、運営者が限定することがあります。
  4. ログインしたアカウントの管理は、利用者の責任で行ってください。他人のアカウントを使うことはできません。

Article 2 (Accounts and available features)

  1. You can view routes without logging in.
  2. Uploading and downloading KML/KMZ files requires logging in. Editing and deleting routes, and leaving the Service, are also done after logging in. You log in with a Google or Microsoft account. RouteCross does not store passwords or access tokens (see the Privacy Policy for details).
  3. Posting requires registering a nickname. The operator may limit who can post.
  4. You are responsible for managing the account you log in with. You may not use another person’s account.

第3条（投稿できるもの）

  1. 投稿できるのは、ツーリング・ドライブのルートで、利用者が共有する権利を持つものに限ります。
  2. 次のものは、投稿できません。
    • 他人の著作権その他の権利を侵害するもの
    • 個人宅とわかる場所を、始点・終点・地点にしているもの（他人の自宅はもちろん、ご自身の自宅も避けてください）
    • 他人の氏名・連絡先など、個人情報を含むもの
    • 犯罪、不法侵入、自傷などを助長するもの
    • 法令または公序良俗に反するもの
    • ルート（地図上の線）を含まないもの、その他、運営者が不適切と判断したもの

Article 3 (What you can post)

  1. You may post only touring and driving routes that you have the right to share.
  2. The following may not be posted:
    • Anything that infringes another person’s copyright or other rights
    • Anything that uses a place identifiable as a private home as the start, the end, or a point (not only other people’s homes; please also avoid your own home)
    • Anything that contains personal information, such as another person’s name or contact details
    • Anything that encourages crime, trespassing, self-harm, and the like
    • Anything that violates laws or public order and morals
    • Anything that does not contain a route (a line on the map), and anything else the operator judges inappropriate

第4条（投稿の権利と利用の許諾）

  1. 投稿したルートの著作権は、投稿者に残ります。
  2. 投稿者は、運営者に対し、本サービス上で投稿を表示するために必要な範囲（地図での表示、一覧、共有、投稿者が許可した場合のダウンロードの提供）で、投稿を利用することを許諾します。
  3. ダウンロードを許可するかどうかは、投稿者が、ルートごとに選べます（初期値は許可しない）。許可していないルートの KML/KMZ は、投稿者本人だけがダウンロードできます。許可しない場合でも、地図での表示と、Google Map の経路リンクは、他の人に表示されます。
  4. 投稿者は、ダウンロードを許可したルートについて、本サービスからダウンロードする人に対し、投稿した KML/KMZ を、個人のツーリング・ドライブの目的で、ダウンロードして利用することを許諾します。再配布と商用利用は、この許諾に含まれません。
  5. 投稿者は、投稿が第三者の権利を侵害していないことを保証します。第三者との間で問題が生じた場合は、投稿者の責任で解決してください。

Article 4 (Rights in posts and license)

  1. The copyright in a route you post remains with you, the poster.
  2. The poster grants the operator permission to use the post to the extent necessary to display it on the Service (display on the map, lists, sharing, and, if the poster has allowed it, providing downloads).
  3. The poster can choose, for each route, whether to allow downloads (the default is not to allow). Only the poster can download the KML/KMZ file of a route that is not allowed for download. Even if downloads are not allowed, the display on the map and the Google Maps route link are shown to other people.
  4. For a route whose download the poster has allowed, the poster grants people who download it from the Service permission to download and use the posted KML/KMZ file for their personal touring and driving purposes. Redistribution and commercial use are not included in this permission.
  5. The poster warrants that the post does not infringe any third party’s rights. If a problem arises with a third party, the poster shall resolve it at the poster’s own responsibility.

第5条（審査・非公開・削除）

  1. 運営者は、投稿の内容を確認し、公開しないことがあります。また、公開後に、非公開にしたり削除したりすることがあります。理由を個別にお伝えしない場合があります。
  2. 投稿者は、自分の投稿のルート名・説明・主な移動手段を、あとから編集できます。また、自分の投稿を削除できます。
  3. マイページから退会（アカウント削除）すると、ニックネームと、投稿したすべてのルート（KML の原本を含む）が削除されます。削除したデータは、元に戻せません。

Article 5 (Review, making posts non-public, and deletion)

  1. The operator may review the content of a post and may decline to publish it. The operator may also make a post non-public or delete it after it has been published. The operator may not explain the reason individually.
  2. Posters can later edit the route name, description, and main mode of transport of their own posts, and can delete their own posts.
  3. If you leave the Service (delete your account) from My page, your nickname and all the routes you posted (including the original KML files) are deleted. Deleted data cannot be restored.

第6条（禁止行為）

次の行為をしないでください。違反した場合は、投稿の非公開・削除や、投稿の停止などの措置を取ることがあります。

  • プログラムなどによる、ルートや投稿者の情報の自動的な大量収集（スクレイピング）。ただし、検索エンジンのクローラーが、robots.txt の指示に従って巡回することは、この行為に含みません。
  • アクセス回数などの制限を回避する行為、本サービスに過度な負荷をかける行為
  • 他の人が作成した KML/KMZ・ルート・説明・地点情報などをコピーし、自分が作成したものとして投稿する行為、および他の利用者の投稿を、無断で再アップロードする行為
  • 不正アクセス、他人へのなりすまし、本サービスの運営を妨げる行為
  • 投稿の停止などの措置を受けたあとに、退会して登録し直したり、別のアカウントを使ったりして、投稿を続ける行為
  • その他、法令または本規約に違反する行為

Article 6 (Prohibited acts)

Please do not do any of the following. If you do, we may take measures such as making your posts non-public or deleting them, or suspending your ability to post.

  • Automated bulk collection of routes or poster information by programs or the like (scraping). However, search engine crawlers visiting according to the instructions in robots.txt are not included.
  • Circumventing limits such as the number of accesses, or putting excessive load on the Service
  • Copying KML/KMZ files, routes, descriptions, place information, etc. created by others and posting them as your own, or re-uploading another user’s post without permission
  • Unauthorized access, impersonating others, or interfering with the operation of the Service
  • Continuing to post after measures such as suspension of your ability to post have been taken, by leaving the Service and registering again or by using another account
  • Any other act that violates laws or these Terms

第7条（ルートの安全について）

  • 掲載されているルートは、不正確であったり、古かったり、危険であったりする場合があります（通行止め、私有地、悪路、天候など）。
  • 実際に走行するかどうかは、ご自身の責任で、交通法規と現地の状況・標識に従って判断してください。
  • 運転中に、本サービスを操作しないでください。

Article 7 (Safety of routes)

  • Routes listed on the Service may be inaccurate, outdated, or dangerous (road closures, private land, rough roads, weather, etc.).
  • Whether to actually ride or drive a route is your own responsibility. Decide according to traffic laws and local conditions and signs.
  • Do not operate the Service while driving.

第8条（免責）

  1. 運営者は、本サービスと投稿の内容について、正確性・安全性・有用性・適法性などを保証しません。
  2. 本サービスを利用したこと、または利用できなかったことによって生じた損害について、運営者は、運営者に故意または重大な過失がある場合を除き、責任を負いません。
  3. Google、Microsoft、地図の提供元など、外部のサービスの障害や変更について、運営者は責任を負いません。

Article 8 (Disclaimer)

  1. The operator does not guarantee the accuracy, safety, usefulness, or legality of the Service or of the posts.
  2. The operator is not liable for damage arising from your use of, or inability to use, the Service, except where the operator has intent or gross negligence.
  3. The operator is not liable for failures or changes of external services such as Google, Microsoft, and map providers.

第9条（個人情報）

個人情報の取り扱いは、プライバシーポリシーに従います。

Article 9 (Personal information)

Personal information is handled according to the Privacy Policy.

第10条（お問い合わせ・権利侵害の申し立て）

権利侵害の申し立て、投稿の削除の依頼、苦情、その他のお問い合わせは、サイトの「お問い合わせ」からご連絡ください。内容を確認し、必要な場合は、投稿を非公開にするなどの対応をします。

Article 10 (Inquiries and reports of rights infringement)

For reports of rights infringement, requests to delete a post, complaints, and other inquiries, please contact us through “Contact” on the site. We will review the content and, where necessary, take measures such as making the post non-public.

第11条（本規約の変更）

運営者は、必要に応じて、本規約を変更することがあります。変更後の本規約は、このページに掲載した時点から効力を生じます。掲載後に本サービスを利用した場合は、変更に同意したものとみなします。

Article 11 (Changes to these Terms)

The operator may change these Terms as needed. The revised Terms take effect when they are posted on this page. If you use the Service after they are posted, you are deemed to have agreed to the changes.

第12条（準拠法・管轄）

本規約は、日本法に従って解釈されます。本サービスに関して紛争が生じた場合は、日本の裁判所を管轄裁判所とします。

Article 12 (Governing law and jurisdiction)

These Terms are governed by and interpreted in accordance with the laws of Japan. If a dispute arises concerning the Service, the courts of Japan shall have jurisdiction.
